Payment methods and price

Customers have the option to carry out all of their orders from the website: www.diloy.com

Each customer declares to have full capacity to use credit cards and that they have sufficient funds to cover all the costs that result from the purchase of products through DILOY.

By pressing the "Pay" button during the purchase process, the member declares to accept fully and without reservations all of the present General Conditions of Sale.

The data registered by DILOY constitutes proof of the transactions made between DILOY and the members of its Private Community. DILOY  will confirm your order via email.

The contractual information is presented originally in Spanish and will be confirmed at the time of delivery at the latest.

The prices of our products are inclusive of all taxes, but do not include transport costs unless expressly indicated.

DILOY reserves the right to modify its prices at any time, but the products will be invoiced based on the prices in force at the time of purchase (subject to the availability of the product), excluding obvious typographical errors.

The products will remain property of the provider until the moment the payment has been completed.

DILOY  reserves the right to reject an order from any member with which it has any contention.

Availability

DILOY will do all it can to satisfy all of its customers in their product availability needs.

In the case that a product is unavailable after the order has been made, the customer will be informed by email of the cancellation of the order.

As a result of this demand, the speed of the return to the bank account of the customer will depend on the type of bank card and the conditions of each bank. These terms are again specified in the "Delivery" clause.

Security

For your security DILOY uses a system of payment by credit card via a payment gateway.

The bank data entered is encrypted and transmitted securely to the servers of the bank and is subsequently verified with the issuing bank to prevent possible fraud and abuse.

This data entry procedure is guaranteed by 128-bit SSL (Secure Socket Layer) encryption technology, one of the most advanced and effective protection systems currently available; thanks to it, no third party will have access to information via the internet relating to the bank data entered by the customer.

Only the Bank and PayPal have access to the banking data linked to these means of payment, so DILOY does not know or register this data during the payment transaction.

Returns

All products sold may be returned within 7 days from the date of delivery, in accordance with the provisions of the Spanish Retail Trade Act.

The customer must previously indicate their intention to return by email. DILOY will reply by another email specifying the precise instructions for the return of the product.

Return costs will be charged to the customer.

The refund on the customer's account as a result of this return will be made within 7 days of receipt of the goods by DILOY.

The return cannot take place under any circumstances if the products supplied have obviously been put to use.

The products must be returned properly protected, in their original packaging, in perfect condition (not damaged or contaminated by the customer) with all accessories, instructions and documentation. They will be sent to the place specified by DILOY in the instructions sent by email for the return of the product.

In the event that the return is not accepted by the supplier because the product returned has been used, these products will remain in the distribution warehouse for collection by the customer, for a period not exceeding thirty days from your return.

Packages that do not contain any attachments that identify the sender (order number, name, address, etc.) cannot be returned either.

Expenses and risks associated with the return of the product will be the responsibility of the sender, who must send them safely and with the necessary guarantees so that the returned goods arrive in perfect condition.

Through DILOY refunds can be made at the price of the products when they were purchased. Once we have received the returned products, DILOY  will verify that they are in good condition and will proceed to the refund of the amount paid minus shipping costs (€7 VAT included), regardless of the current price of the returned product.

The person returning the product will receive an email informing them of the refund amount.

Guarantee

The guarantees and after-sales services will be governed by Royal Legislative Decree 1/2007 of November 16 approving the text of the General Law for the Defence of Consumers and Users. According to this standard, the seller is obliged to deliver to the consumer and user products that are in compliance with the contract, and must respond them in the event of any non-compliance. The consumer and user has the right to have the product repaired, replaced or reduced or the contract terminated.

Liability, litigation and applicable law

DILOY shall not be held liable for any breach of contract arising in the event of a lack of stock or unavailability of the product, force majeure, total or partial disruption or strike, in particular postal services and means of transport and/or communications, flood or fire. In case of litigation, the member must first contact DILOY  to obtain an amicable solution.

The Courts of Madrid are the only competent authority. The present general conditions of sale will be interpreted in their original Spanish-language version and will be carried out according to the Spanish law. Any disagreement that may arise with respect to their validity, interpretation or execution shall be submitted to the Courts of Madrid, to which exclusive attribution of competence is expressly made.

Modification of the general conditions of sale

DILOY reserves the right to modify the general conditions of sale without prior notice, and is able to change, suppress or add to both the contents and services provided through it and the way in which they appear presented or located in their servers.

These changes must be accepted by the user every time they make a purchase through the DILOY page.

Members of the “DILOY Private Community" who do not comply with the modifications of the general conditions, must indicate this and, from the date on which the new version takes effect, must stop using DILOY services. In the event that one of the terms of the general conditions is illegal or unenforceable, it will be null and void, and the agreements made between the parties will apply, or otherwise, the provisions of the Spanish Civil Code.
